I find it interesting when what many perceive to bad or intrusive legislation that the proponents will declare that the Constitution is a “living document”.

Their intent is to say that aspects of it may become out of step with current times and so must be updated.

Maybe it is a living document-if so then the argument that “all men are created equal” should be the litmus test for any and all legislation-any amendments to the Bill  of Rights- the concept should remain alive.

The Fourth Amendment which states:

“The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no Warrants shall issue, but upon probable cause, supported by Oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized.”
